When Am I Legally Required to Install a Charging Station in My Car Park?

In Poland, regulations on electromobility impose an obligation to install electric vehicle (EV) charging stations in parking areas and adjacent to buildings. These provisions stem from the Act on Electromobility and Alternative Fuels of 2018, as amended in 2024. If you are the owner of a commercial or service facility, a property developer, or a building manager, this article will help you understand how to adapt your property to the new legal framework—and how to turn this obligation into an additional source of revenue.

Legal Requirements

Article 12a of the amended Act on Electromobility and Alternative Fuels (2024) introduces specific requirements for the installation of EV charging infrastructure in parking areas. These requirements come into force on 1 January 2025.

Multi-Family Residential Buildings

If you are planning the construction of a new multi-family residential building or housing estate with more than 10 car parking spaces, you are required to provide appropriate EV charging infrastructure. This means that during the design and construction stages, the project must include the installation of cable trays and conduits for electrical wiring at all car parking spaces, enabling the future installation of charging points at each space.

Modernisation of Existing Buildings

In the case of modernising buildings with at least 10 car parking spaces, the regulations impose an obligation to prepare the infrastructure necessary for the installation of EV charging stations. Such modernisation of parking facilities must include the provision of technical infrastructure that will allow for the straightforward installation of charging stations in the future.

Public Car Park at Commercial and Public-Use Buildings

The obligation to install EV charging points also applies to owners and managers of non-residential buildings with at least 10 car parking spaces. In these cases, at least one charging point must be provided for every five car parking spaces, and electrical wiring and sockets must be installed to allow for the future connection of charging stations.

The Charging Point Requirement as an Opportunity for Additional Revenue

You don’t have to view the obligations introduced by the Act on Electromobility solely as an additional cost or an administrative burden. On the contrary—this may be an opportunity for growth and for turning your car park into a new source of income. Investing in electric vehicle charging infrastructure—regardless of how it is implemented—opens up the possibility of generating profit and attracting new customers. Below, we present two main ways to make the most of this potential.

Revenue from Leasing Car Park Spaces

If you own car park spaces, you can generate a steady income without significant investment. All you need to do is lease the space to a company that will install its own charging stations and take care of the installation, maintenance, and operation of the equipment. This way, you:

  • gain stable rental income,
  • increase the attractiveness of your facility, and
  • ensure compliance with legal requirements

without having to engage in the technical aspects of charging infrastructure.

Owning a Charging Station as a Source of Revenue

By choosing to purchase and install your own charging station, you gain full control over the infrastructure and can directly benefit financially from each charging session. You manage the equipment, set your own prices, and collect fees for both energy consumption and the time vehicles spend at the charging space. This gives you:

  • direct revenue,
  • flexibility in pricing,
  • increased visibility and attractiveness of the location,
  • a company image aligned with electromobility,
  • a competitive advantage

Choosing the Right Charging Station

Regardless of the business model you choose, selecting the right charging station is a key step that affects the efficiency of the infrastructure and customer satisfaction. It is essential to invest in durable, reliable equipment that will operate without failure for many years. When choosing a device, it is important to consider not only the price, but also build quality, availability of technical support, and after-sales service. You can read more about this HERE.
